Terms and Conditions
- Payment Terms
Payment terms are strictly 30 (thirty) days from the date of invoice for approved account holders. All other customers are required to pay on a cash-on-delivery (COD) basis. - Overdue Accounts and Interest
If any payment is not made by the due date, the full outstanding amount becomes immediately due and payable—regardless of whether certain portions were not yet due at the time. Interest will be charged on all overdue amounts at a compound rate of 3% per annum above the prime overdraft rate of our bankers. In the event of default, Physio-Med Technologies reserves the right to place the customer on stop supply without prior notice, even if goods were ordered before the stop supply date. - Legal Costs
Should Physio-Med Technologies instruct attorneys to recover any outstanding amounts, the customer will be liable for all legal fees, collection charges, and tracing agent costs on an attorney-and-client scale. Payments received will be applied first to legal and collection fees, then to interest, and lastly to capital. - Jurisdiction
The customer and any surety consent to the jurisdiction of the Magistrate’s Court for any legal action arising from these terms, regardless of the amount involved. - Courier Deliveries
Where delivery is made by courier, the courier is deemed to act as the customer’s agent. Delivery to the courier constitutes delivery to the customer. - Retention of Ownership
All goods remain the sole property of Physio-Med Technologies until full payment is received. Ownership passes only once payment is made in full. - Amendments to Terms
No changes—whether amendments, deletions, or additions—to these terms will be valid unless agreed to in writing and signed by an authorised representative of Physio-Med Technologies. No oral agreement or promise to amend these terms shall be binding, even if it induced the customer or surety to sign this agreement. - Domicilium and Notices
The customer and any surety choose their physical address, as stated on the face of this document, as their domicilium citandi et executandi for purposes of receiving all notices and legal documents related to this agreement. - No Waiver
No relaxation or indulgence granted by Physio-Med Technologies shall be interpreted as a waiver of any rights under this agreement. Any such leniency does not imply a change to the agreement or prevent Physio-Med Technologies from enforcing its full rights later. - Protection of Personal Information (POPIA Compliance)
Physio-Med Technologies complies with the Protection of Personal Information Act, 4 of 2013 (POPIA). By entering into this agreement, the customer consents to the collection, use, and storage of their personal information for the purposes of managing their account, processing orders, delivering goods, communicating invoices and statements, and complying with legal obligations.
Physio-Med Technologies will take reasonable steps to protect the confidentiality and integrity of all personal information. Customer information will not be shared with third parties except where:
- Required by law;
- Necessary to carry out the terms of this agreement (e.g., delivery services or credit checks); or
- With the customer’s prior consent.
Customers have the right to request access to, correction of, or deletion of their personal information held by Physio-Med Technologies, subject to applicable law.
